Terms of Use & Privacy Policy

By utilizing the Surveys On The Go® app (the “SOTG App” or “App”), you agree to be legally bound by the terms and conditions set forth below (the “Terms of Use” or “Agreement”). The terms “you,” “Member” and “User” refer to anyone who accesses the SOTG app.

IMPORTANT INFORMATION ABOUT PRIVACY

The App is a survey and opinion collection application, so if you join our panel we will ask and collect the information you’ll provide us. See Privacy Policy (below) for more information. Such information may include your name, e-mail address, user name, and password. In addition, the App collects some information about your mobile phone automatically, such as the type of mobile device you use and the device’s unique ID and IP address.

If you agree to share your geographic location, your phone will notify us when you visit key locations, so we can send you location-specific surveys. You can stop the data collection process by deleting the App, or you can stop geographic survey features by disabling location alerts. The data collected for this App is for market research purposes and may be used to deliver relevant advertising to you, but we do not allow companies or agencies to contact you directly. 

DEFINITIONS

For the purposes of this Terms of Use and Privacy Policy, the following definitions apply:

• Account – A registered profile created by a User in the SOTG App, allowing access to surveys, Bonus Gigs, the Payday Program, and other features.
• Bonus Gigs (Gigs) – Optional opportunities within the SOTG App where Users can complete specific tasks or milestones through a third-party offerwall in exchange for incentives.
• Geographic Location Information – Precise location data collected from a User’s device when permission is granted, used to provide location-based surveys, advertisements, and other services.
• Incentives (SOTG App Incentives) – Compensation, such as cash rewards or other benefits, awarded to Users for participation in surveys, the Payday Program, and Bonus Gigs.
• Partners – Third-party companies, research firms, or advertisers that receive aggregated, de-identified, or otherwise non-personally identifiable data from SOTG for research, analytics, and advertising purposes.
• Payday Program – An optional incentive program where Users can earn weekly rewards by permitting the ongoing collection of Geographic Location Information and Digital Data, as described in the Privacy Policy.
• Personal Information – Any data that identifies or relates to an individual User, including but not limited to name, email address, geographic location, device identifiers, and survey responses, as outlined in the Privacy Policy.
• Services – The collective features, functions, and offerings of the SOTG App, including surveys, Bonus Gigs, the Payday Program, data collection, and any other functionality described in the Terms of Use and Privacy Policy.
• SOTG App – The Surveys On The Go® mobile application, operated by MFour Mobile Research, Inc., where Users can participate in surveys, Bonus Gigs, the Payday Program, and other data collection activities.
• Surveys – Market research studies available within the SOTG App, where Users provide responses to questions in exchange for incentives.
• User (Member) – Any individual who has registered for an Account and interacts with the SOTG App.

I. TERMS OF USE

Subject to applicable laws and regulations, Surveys on the Go® (SOTG) may change these Terms of Use at any time either with notice through the application or by email. SOTG is also known as MFour Mobile Research, Inc.®  Changes will be posted on the SOTG App and/or sent to you via email and such changes shall be effective no later than thirty (30) days after notice. You agree to review the App periodically to be aware of any such amendments. Your continued use of the App after such amendments have been made shall constitute acceptance of the amendments. If any of these changes are unacceptable, you are not authorized to access the SOTG App and should delete the App from your device.

1. Eligibility

Accounts in the SOTG App are limited to individuals only. Corporations and other business entities are not eligible. Use of automated services or machines is not permitted. Use of the App requires you to establish an account and is limited to one (1) account per person, even if the individual has multiple e-mail addresses. Users must be 13 years of age or older to use the App. By using the SOTG App you represent you are 13 or older. If Surveys on the Go discovers that a user under 13 years of age has created an account, or that a user or visitor under 13 years of age has posted personally identifiable information or other content to the SOTG App, Surveys on the Go will terminate the account and remove the information or other content. If you do not meet all of these requirements, you must not access or use the SOTG App.

2. Member Registration Obligations

As part of the registration process, you must provide SOTG with accurate, complete, and updated information, including your first name, last name, and a valid email address. Failure to do so constitutes a breach of this Agreement, which may result in immediate termination of your access to the App and forfeiture of incentive payments. Please see our Privacy Policy for information regarding how this information will be used and maintained. As part of the registration process you must select a password. You are responsible for maintaining the confidentiality of the password used to log into the SOTG App and you accept responsibility for all activities, charges and damages that occur in relation to your account. You shall promptly contact SOTG if you believe there has been unauthorized use of your account. In order to prevent unauthorized activity or access to your SOTG App account, you must provide your e-mail address and selected password in order to update your profile information, update personal information (name, e-mail address, etc.) and redeem incentives.

You agree to abide by all applicable laws and regulations with respect to your SOTG App account.

3. Password/Account Access Rights & Responsibilities

SOTG may act upon any instructions received under your password and e-mail address without further verification. SOTG cannot and will not be liable for any incentive credits or debits made to your account by anyone who uses your password.

4. Earning SOTG App Incentives

You agree to receive invitations to participate in surveys, Bonus Gigs (gigs), and the Payday Program from SOTG via email and the App “push/badge” notification system. You may earn “SOTG App Incentives”  when you complete a survey, a gig, or meet the eligibility criteria for the Payday Program. The amount or type of incentives that can be earned will be stipulated in each survey or gig invitation, or as part of the Payday Program terms.

Not all surveys, gigs, or the Payday Program will include incentives, and participation in any of these activities is optional.

You will receive an incentive only for completed and submitted surveys or gigs unless otherwise stated in the respective invitation or offer. If you begin, then save a survey or gig to complete at a later time or date, you acknowledge that survey respondent quotas may fill up or the gig may no longer be available, resulting in the survey or gig being closed before completion. You will not be entitled to any incentive if a survey or gig closes before you submit the completed activity.

5. Redeeming Incentives

Cash Incentives: For surveys, gigs, or the Payday Program incentives that provide cash rewards, you are not entitled to receive payment of any such cash rewards until your account reaches a minimum balance of $10.00 USD.  Cash incentives are paid through methods made available in the App. Such methods may include PayPal, an Amazon or Starbucks account credit or Visa gift card. These cash incentive payment methods may be changed by SOTG at any time. 

SOTG App Incentives and account balances are not transferable by gift, upon death, as part of a domestic matter, or otherwise.  SOTG App Incentives and accounts may not be auctioned, traded, bartered or sold. Your SOTG App account may not be merged with the account of any other Member under any circumstances. 

SOTG reserves the right to change the incentive program to include different types of awards beyond cash, such as a points-based system. In the event that the incentive program is changed from cash to a points system, you will be given equal value in points for the existing balance in your account.

6. Expiration of SOTG App Incentives

If your account has been inactive for more than 365 consecutive days from the last date of activity, one hundred percent (100%) of any SOTG App Incentives remaining in your account will be forfeited.

7. Intellectual Property Rights 7 Unlawful Use

The SOTG App is the property of MFour Mobile Research, Inc. or its licensors, and is protected by copyright and other intellectual property laws. All trade names, trademarks, service marks and other product and service names and logos on the App and within the Content (as defined below), including the name SOTG are proprietary to their respective owners and are protected by applicable trademark and copyright laws. Any of the trademarks, service marks or logos (collectively, the “Marks”) displayed on the App may be registered or unregistered marks of SOTG or others. You agree that you will not copy, share or replicate any of the information, questions, images or videos provided during surveys, (the “Content”), modify any Content, or delete or alter any copyright, trademark, or other proprietary rights notices from Content. You may not access or use for any commercial purposes any part of the SOTG App. Such actions will be considered a material violation of this Terms of Use and will result in immediate termination of your right to access and use the SOTG App as well as potential civil penalties. Nothing contained in the App should be construed as granting any license, title or right by implication, estoppel or otherwise to use any of the Marks displayed on the App without the express written permission of SOTG or a third-party owner of such Marks. All rights not expressly granted are reserved by SOTG. You shall honor all reasonable requests by SOTG to protect the proprietary interests of SOTG in the App and the Content. Illegal and unauthorized uses of the Marks or any other Content are strictly prohibited.

8. Member Conduct

You agree to not use the SOTG App to:

• Violate applicable law;
• Impersonate any person, or misrepresent your identity;
• Interfere with, disrupt or violate the terms and conditions and operating rules of the SOTG App or servers or networks connected to SOTG; or disobey any requirements, procedures, policies, or regulations of such networks;
• Interfere with another Member’s use or enjoyment of the SOTG App;
• Attempt to gain unauthorized access to the SOTG App, or to any other accounts, web sites, computer systems, or network;
• Transmit any file that contains viruses, worms, Trojan horses, or any other contaminating or destructive features;
• Use the SOTG App to conduct any activity or solicit the performance of any illegal activity or other activity that infringes the rights of others;
• Provide access to the SOTG App to others using your personal account.

You agree to provide truthful and appropriate answers to all survey questions and requests for personal or demographic information. SOTG reserves the right to withhold cash or non-cash incentives to you if SOTG determines, in good faith, that your responses to survey questions are not truthful or appropriately considered.

9. Anti-hacking Provision

You expressly agree not to use the SOTG App to:

• Launch or attempt to launch any “deep-link,” “scraper,” “robot,” “bot,” “spider,” “data-mining,” “computer code” or any other automated device, program, tool, algorithm, process, or methodology or manual process having similar processes or functionality, to access, acquire,
• Copy, or monitor any portion of the App, any data or Content found on or accessed through the App or any other Content without the prior express written consent of SOTG;
• Obtain or attempt to obtain through any means any materials or information on the App that have not been intentionally made publicly available either by their public display on the App or through their accessibility by a visible link on the App;
• Violate the restrictions in any robot inclusion headers on this App or in any way bypass or circumvent any other measure employed to limit or prevent access to the App or its Content; violate the security of the App or attempt to gain unauthorized access to the App, data, materials, information, Web Sites, computer systems or networks connected to any server, through hacking, password mining or any other means;
• Interfere or attempt to interfere with the proper working of the App or any activities conducted on or through any web site, including accessing any data, content or other information prior to the time that it is intended to be available to the public on the App;
• Take or attempt any action that, in the sole discretion of SOTG, imposes or may impose an unreasonable or disproportionately large load or burden on the infrastructure of SOTG.

10. Termination

This Agreement, and your account, may be terminated as follows:

• Member Termination. You have the right to terminate this Agreement and your SOTG App account at any time by deleting the application from your mobile device. Inactive accounts will also be automatically closed and deactivated after 365 consecutive days of inactivity.
• SOTG Termination. SOTG may terminate this Agreement and your SOTG App account effective immediately and without prior notice, for any reason, including, without limitation, inactivity, failure to provide accurate information or valid survey responses, or if SOTG believes in its sole discretion that you have violated or acted inconsistently with this Agreement.

11. Disclaimer of Warranties & Liability

Your use of the App is at your own risk.  The App and its content are provided on an “as is” and “as available” basis, without any warranties of any kind. You are entirely liable for activities conducted by you in connection with your use of the SOTG App. If you are dissatisfied with the App or with these Terms of Use, your sole and exclusive remedy is to cease using the App. Neither SOTG nor any third-party provider will pay you any damages in connection with your access or non-access to the SOTG App. Neither SOTG, their affiliates, nor their third-party providers guarantee the accuracy, completeness, timeliness or availability of any Content provided through this App. You understand that we cannot and do not guarantee or warrant that the App will be free of viruses or other destructive code. To the fullest extent provided by law, we will not be liable for any loss or damage caused by a virus or other technologically harmful material.  SOTG, their affiliates, third-party providers, their directors, officers, shareholders, employees and agents are not responsible for any errors or omissions, regardless of the cause, or for the results obtained from the use of such information.

SOTG, SOTG AFFILIATES AND THIRD-PARTY PROVIDERS DISCLAIM ANY AND ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE. In no event shall SOTG, their affiliates or their third-party providers and their directors, officers, shareholders, employees or agents be liable to any party for any direct, indirect, incidental, exemplary, compensatory, punitive, special or consequential damages, costs, expenses, legal fees, or losses (including, without limitation, lost income or lost profits and opportunity costs) in connection with any use of such information or the SOTG App even if SOTG has been advised of the possibility of such damages.

12. Links to Other Web Sites From this Web Site

You may, through hypertext or other computer links on the App, gain access to websites operated by persons other than SOTG. Such hyperlinks are provided for your reference and convenience only, and are the exclusive responsibility of such websites’ owners. Please be aware that these third party sites are governed by their own terms, which should be reviewed before use. You agree that SOTG is not responsible for the content or operation of such websites, and that SOTG shall have no liability to you or any other person or entity for the use of third-party websites. Except as described below, a hyperlink from this app to another website does not imply or mean that SOTG endorses the content on that website or the operator or operations of that site. You are solely responsible for determining the extent to which you may use any content at any other websites to which you link from this app. SOTG assumes no responsibility for the use of third-party software on the website and shall have no liability whatsoever to any person or entity for the accuracy or completeness of any outcome generated by such software.

13. User Content

The User grants to SOTG the non-exclusive and perpetual right to use all Content entered into or on the App by the User (other than User Registration Information) in any medium and for any purpose.

Users posting Content on the App are responsible for the content of that material. SOTG has no responsibility for User Content or for the content of any messages or information posted by Users or others, or for the content of information accessible on the Internet, even if accessed via direct or indirect hyperlinks from the App. However, SOTG retains the right, which it may or may not exercise in its sole discretion, to review, edit, or delete User Content that SOTG deems to be illegal, offensive, or otherwise inappropriate. The User is solely responsible for all access to, usage of, or activity on, such User’s account/profile including, but not limited to, use of the account/profile by any person who uses your password to access the SOTG App, with or without authorization, or who has access to any computer, mobile or other device on which your account/profile resides or is accessible. The User agrees not to post, upload, transmit, send or otherwise make available on or through the App any Content which such User is bound not to disclose by agreement, contract, fiduciary duty, employment relationship, or otherwise, including but not limited to, insider information, proprietary and/or confidential information, trade secrets or Content that infringes upon any third-party’s rights.

The User agrees to indemnify SOTG and any third-party data providers, from all damages, liabilities, costs, charges and expenses, including reasonable attorneys’ fees, that SOTG, its affiliates, employees, and authorized representatives may incur as a result of any claim arising out of User Content posted using your email address and password, including without limitation, that which violates these Terms of Use and/or applicable laws.

14. Additional Legal Terms – User Agreement to These Terms of Use

Subject applicable laws and regulations, SOTG may discontinue or change the App, or its availability to you, at any time. Your agreement to these Terms of Use survives any such discontinuation. These Terms of Use, constitute the entire agreement between the parties relating to the SOTG App and supersedes any and all other agreements, oral or in writing, with respect to the App. The failure of SOTG to insist upon strict compliance with any term of this Agreement shall not be construed as a waiver with regard to any subsequent failure to comply with such term or provision. This Agreement is personal to you, and you may not assign your rights or obligations to anyone. If any provision in this Agreement is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect. This Agreement, your rights and obligations, and all actions contemplated by this Agreement shall be governed by the laws of the United States of America and the State of California. The parties agree that the State and Federal courts of California shall be the exclusive forums for any dispute arising out of this Agreement and the parties hereby consent to the personal jurisdiction of such courts.

15. Indemnification

You agree to indemnify and hold harmless SOTG and its current and future subsidiaries, successors, affiliates, licensors, suppliers, co-branders, third-party providers, clients, sponsors, and partners, and the officers, directors, employees, and agents of each of them, from and against any and all claims, losses, costs (including court costs), fees (including legal fees), damages and expenses that any such party may incur as a result of, due to, or arising out of violation by you (or anyone acting under your account or password) of this agreement or the use or misuse of the SOTG App by you (or anyone acting under your account or password), the violation of any rights of another by you (or anyone acting under your account or password) or your use of any information obtained from the App.

16. Limitation on Time to File Claims

Any cause of action or claim you may have arising out of or relating to this Agreement must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.

II. PRIVACY POLICY

This privacy policy is effective as of February 13, 2025.  MFour Mobile Research, Inc. (“MFour,” “we,” “us,” “our”) is committed to protecting the privacy and security of your personal information. We also want to be upfront and clear about information we collect, how we use it, and rights you may have. MFour is a market research technology company providing services, including sharing data, to other market research companies, third parties operating in the ad tech sector, companies providing products and services to consumers, and other parties (collectively “Partners”) for the purposes of market research, including ad measurement, analytics and reporting, and other purposes. MFour does not share data with Partners that would use the data to directly contact you. 

This Privacy Policy explains how we collect, use, and share information when individuals (“you”) visit or interact with our websites including www.surveysonthego.com, www.surveysonthego.net, www.mfour.com, and www.mfour.net (the “Sites”), and the Surveys On The Go® mobile application (the “SOTG App”). The Sites and the SOTG App together are called the “Services” in this Privacy Policy.

The SOTG App is available in the Apple App Store and Google Play Store. If you download the SOTG App, you will be able to create an account and receive and respond to surveys that we conduct for our use or on behalf of our Partners. We offer you incentives in exchange for your survey participation. As explained in more detail below, we share survey results and other information collected through the SOTG App with our Partners who typically use the information we provide to conduct and improve their products, services, and advertising. From time to time, we may permit selected third parties to provide you with additional survey opportunities in the SOTG App. If you decide to participate in those additional opportunities, your participation in those third-party surveys will be directly with those third parties and will not be governed by this Privacy Policy.

The SOTG App is not offered outside the United States. For US individuals who use the SOTG App, we may use the information that we collect (as described below) to avoid sending you surveys from us or a third party while traveling outside the United States.

1. Types of information collected and how we collect them

Personal information you provide to us
When you use the Services, we collect personal information that you provide to us. This information may include your name, address, telephone number, email address, and linked information such as zip code, demographic information (such as your age, gender, income, education level, etc.), and other information. We collect this information when you voluntarily provide it to us when creating an account after downloading the SOTG App, when you use the SOTG App to update your account information, and when you respond to surveys. 

We will use demographic and other information you provide to send you relevant surveys and for other internal purposes. If you participate in a survey, we will collect information and responses that you provide in the course of the survey. For some surveys, this may include photo, audio, and video information that you provide. If you use our Facebook log-in tool, we may collect the information you choose to make publicly available through your Facebook profile such as your name, date of birth, email address, and residence location. You can control what specific information is made public through your use of your Facebook privacy settings.

Personal information collected automatically
We collect certain personal information automatically through the SOTG App and when you visit the Sites.  Geographic Location Information and Digital Data (described below) will be collected automatically only if you give permission.  Personal information that is automatically collected includes the following:

Geographic Location Information. If permitted on your device and with your permission, the SOTG App may automatically collect and use your Geographic Location Information, which includes precise location information from your device.

You will receive prior notice and must give your consent before your Geographic Location Information is collected through the SOTG App (in the event that you share your device with another person, please be aware that this person could change these permissions on your behalf). If you do not want to provide your Geographic Location Information through the SOTG App, you may use the controls available in the SOTG App and/or available on your mobile device to limit this sharing.  Some incentives and features may not be available if you stop the collection of Geographic Location Information.

Usage and Device Data. We may automatically collect certain types of usage and device data when you visit our Sites or use the SOTG App. We use a variety of technologies to collect this data automatically, including cookies, pixels, and similar technology.  For example, we use such technologies, and the usage and device data they collect, to make it easier for you to navigate our Services, to provide a better experience for you when you participate in surveys, and for quality control and validation purposes. Cookies are small text files or other forms of data which are stored on a computer by a website and can store certain information about the internet browsing activity on that computer. You may be able to disable and/or delete cookies via your browser and/or plug-in settings; however, this may: (1) decrease the functionality of our Sites and other websites you visit; (2) limit your ability to use and view our Services; and (3) limit your participation in the Services, including incentivized surveys. Even if you disable cookies, we may collect and use other information that identifies your device over time to provide our Services.

The information we collect automatically when you visit the Sites or use the Services includes, for example, IP address, pages visited and other activities on the Services, information about your other online activities, streaming video services you use and the content you watch, general geographic location derived from IP address, and time and date of your activities. We also collect information about your device and its software, such as your mobile advertising identifier, device manufacturer, device type, device model, operating system and version, browser type, wireless carrier/provider information, Internet service provider, and a randomized unique ID (that allows us to uniquely identify your browser, mobile device, or SOTG account).

Digital Data. If permitted on your device and with your permission, the SOTG App may automatically collect Digital Data about your other online activities outside the SOTG App, including webpages you visit on the device, apps that you use on the device, information about how and for how long you use the apps, and apps that you install and uninstall.  The Digital Data collected also includes activities and purchases you make on e-commerce apps and websites. 

To provide Digital Data, you must enable accessibility permissions on Android devices and download a Virtual Private Network (VPN) tool on iOS devices.  If you want to stop providing Digital Data through the SOTG App, you can use the controls available in the SOTG App and/or available on your mobile device to disable the collection of Digital Data.  You may also stop providing Digital Data by disabling accessibility permissions on Android devices or disabling and/or uninstalling the VPN on iOS devices. Some incentives and features may not be available as a result of stopping the collection of Digital Data.

Personal information from third parties

We also obtain personal and other information about you from third parties, which we often combine with personal information we collect automatically or that you provide to us. For example, Partners and other parties may provide us with your mobile advertising identifier, demographic and address information, and other information. 

We may also use analytics services provided by third parties. These service providers may use cookies or other technologies to collect information about your online activities on the Sites, the SOTG App, and other sites and apps over time for analytics purposes. For example, we use Google Analytics to understand how visitors use our Sites. To opt out of Google Analytics, visit https://tools.google.com/dlpage/gaoptout.

2. Additional Optional SOTG App Incentives and Data Collection

In addition to standard survey rewards, the SOTG App offers optional incentive programs, including the Payday Program and Bonus Gigs, which allow you to earn additional incentives. Participation in these programs is voluntary. However, if you choose to participate, we may collect and share certain data to facilitate these incentives, as described below.

Each program has its own eligibility criteria and may require different types of data collection. By opting into these programs, you acknowledge and agree to the data collection and sharing practices outlined in this section. If you do not participate, your data will still be collected and used as described in other sections of this Privacy Policy, but it will not be shared in connection with these specific programs.

2.1 Payday Program

Payday is an optional program that allows you to receive a weekly incentive in addition to survey incentives.  If you choose to participate in Payday, you may also receive more surveys.  In order to be eligible for Payday, you must consent to and allow us to automatically collect Geographic Location Information and Digital Data as described above. We will use and share this information as described in this Privacy Policy.  You will automatically be eligible for a Payday incentive if you provide Geographic Location Information and Digital Data for at least 15 days during a month and log into the SOTG app at least once during a month.  Even if you do not participate in Payday, we may still collect, use, and share information through the Services as described in other sections of this Privacy Policy.

You can permanently disable or temporarily pause the collection of Geographic Location Information and/or Digital Data at any time, but stopping this data collection will affect your eligibility for a Payday incentive.  If you want to stop providing Geographic Location Information and/or Digital Data to us through the SOTG App, you can use the controls available in the SOTG App and/or available on your mobile device.  You may also stop providing Digital Data by disabling accessibility permissions on Android devices and disabling and/or uninstalling the VPN on iOS devices. Some incentives and features may not be available as a result of stopping the collection of Digital Data. Pausing or disabling our collection of Geographic Location Information and/or Digital Data will not pause or disable any other data collection through our Services, and you will continue to receive surveys through the SOTG App.  For California residents, please see below for our Notice of Financial Incentive for SOTG including the Payday program.

2.2 Bonus Gigs

Bonus Gigs is an optional program that allows you to earn additional incentives by completing offers from a list of available opportunities. If you choose to participate in Bonus Gigs, you may select specific offers and complete the required milestones to receive an incentive. To participate in Bonus Gigs, you must voluntarily engage with an offer and meet the specified completion criteria. The requirements for each offer, including the action needed and the corresponding incentive, will be outlined before participation. Your participation in Bonus Gigs does not impact your eligibility for other incentives, including survey rewards or the Payday program.

Bonus Gigs opportunities are provided through a third party, and participation in these offers may require you to share certain information with the third party. Please note that these third parties may have their own terms and privacy policies that govern how they collect and use your data. Even if you do not participate in Bonus Gigs, we may still collect, use, and share information through the Services as described in other sections of this Privacy Policy.

If you no longer wish to participate in Bonus Gigs, you can simply choose not to engage with any offers. Opting out of Bonus Gigs will not affect your ability to receive survey invitations or other incentives through the SOTG App. For California residents, please see below for our Notice of Financial Incentive for SOTG, including the Bonus Gigs program.

3. How we use and retain personal information

We use the information we collect for purposes described in this Privacy Policy or as otherwise disclosed to you on our Sites and in the SOTG App, including market research.  We do not use the personal information that we collect through the SOTG App to directly contact you.  For example, we use information we collect for:

• Providing you with relevant survey opportunities. For example, demographic information may be used to match you to types of consumers a Partner may want to survey. Or, your location data may be used to offer you surveys while you are visiting a specific location such as a store or restaurant.
• Providing you with relevant Bonus Gig opportunities.  For example, we may use device data to assess your eligibility for compensation for completing a gig, whether through our platform or a third-party offerwall.
• Market research, including sharing data with our Partners as further described in the next section. 
• Conducting our research and analysis to improve our products and services, identify consumer trends, develop consumer segments and other market research purposes.
• Our compliance with laws and legal obligations and maintaining the security of our Services and your information.
• Detecting and preventing fraudulent users of the Services and survey responses and other fraudulent activities.
• Paying incentives to you using your email address or other information.
• Communicating with you such as responding to your comments or questions, authenticating your identity, and providing you with updates to our products and services.
• Monitoring, administering, and enhancing our Services, including troubleshooting, data analysis, testing, research, statistical, and survey purposes.

We retain your SOTG App account information over time in order to provide the Services to you, including to offer you additional survey opportunities for Partners or for our internal research.

4. Disclosures of personal information

We want you to understand when and with whom we share your personal information.  We may disclose your personal information in the ways described below.  When we sell or otherwise provide personal information to our Partners, we restrict them by contract from using personal information collected through the SOTG App to directly contact you.

• To our Partners, which handle the information according to their own privacy policies. We share information with our Partners to provide them with our services or for their own purposes. Typically, the information we share with Partners can include personal information, survey responses, Geographic Location Information, Digital Data, and/or demographic information associated with unique identifiers such as hashed email addresses, device identifiers, or other alphanumeric identifiers used for internal purposes. We may also provide Partners with aggregate reports that include combined demographic or other survey data.  We may also permit selected third parties to collect and use your Geographic Location Information through our SOTG App to provide you additional survey opportunities from those third parties.
• Authorized third-party vendors and service providers.​ In some cases, we share information we collect with authorized contractors, subcontractors, vendors, and service providers who help us operate our business and provide the Services.  For example, we may share personal information with service providers that provide services such as web hosting, data analysis and reporting, auditing and compliance, network and data security, and identifying consumer demographics and geolocation.
• Legal purposes.​ We disclose personal information when we believe in good faith that the law requires it, pursuant to a court order, subpoena, warrant, in response to a law enforcement request, or as otherwise required or requested by law, regulation, or government authority programs; when disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating the law or our rights or interfering with (either intentionally or unintentionally) use of Services or to protect our rights or the rights or safety of others; and for other legal related purposes.
• Business event. We may disclose personal information in connection with an actual or potential sale of stock or assets, merger, or any other change of control transaction (including in bankruptcy), or in the case of a bulk or partial sale, or other transfer (including third party panelist administration) of information to another research organization or entity.
• With your consent​. We share personal information for any other purpose disclosed to you with your consent.

We may also share and disclose information that is aggregated, de-identified, or otherwise does not specifically identify you or your device, in our discretion including to our Partners.

5. Third-party links & tools

Our Services may provide links to third-party websites or apps, including offers and links to additional survey opportunities on third-party platforms. We do not control the privacy practices of those websites or apps, and they are not covered by this Privacy Policy. You should review the privacy policies of other websites or apps to learn about their data practices.

Our Services may also include integrated social media tools, such as our Facebook log-in tool.  If you use these tools or otherwise interact with these features on the Services, those companies may collect information about you and may use and share such information in accordance with your account settings, including by sharing such information with us and the general public.  Your interactions with third-party companies and your use of their features are governed by the privacy notices of the companies that provide those features.  We encourage you to carefully read the privacy notices of any accounts you create and use.

6. Updating your personal information, deactivating your SOTG account, and stopping information collection

If you have a SOTG App account, you can review, change, or update some of your account information under the “Profile” tab in the SOTG App. 

You can also ask us to delete your personal information related to your SOTG App account from our active files by emailing us at [e-mail]. We may still retain some personal information as needed for legal and recordkeeping purposes, where permitted by law. A request to delete your personal information will not affect any information that we previously shared with Partners or other third parties as described above. In all other cases, we will retain information as long as required by law or as long as needed for our business purposes.

If you no longer want us to collect information from you via the SOTG App, you can stop responding to surveys and delete and uninstall the SOTG App from your device.  We will keep your account information in our records in case you want to reinstall the SOTG Application and reactivate your account. We may also continue to use and share the information that you previously provided, as described in this Privacy Policy.

7. Minors under 16

We do not knowingly collect or sell personal information about individuals under the age of 16. If we learn that a person under 16 has provided us with personal information, we will endeavor to delete that information from our database. If you are a parent or legal guardian and believe that your child who is under 16 may have given us personal information, please contact us.

8. California privacy rights

This section contains disclosures required by the California Consumer Privacy Act (“CCPA”) and applies only to “personal information” that is subject to the CCPA. 

Personal Information We Collect.
In the past 12 months, we collected the categories of personal information about California consumers listed below:

Verification Process and Required Information.
Note that we may need to request additional information from you to verify your identity or understand the scope of your request, although you will not be required to create an account with us to submit a request or have it fulfilled.  You may be required to provide the following for verification purposes:

• Your first and last name
• Your email address
• Your telephone number

Authorized Agent.
You may designate an authorized agent to make a CCPA request on your behalf by providing us with a power of attorney or your written permission to allow the authorized agent to submit the request on your behalf and verification of your identity.

If you are a resident of any state with enacted data privacy laws, you may have certain rights concerning your personal information. These rights can include:

• Right to Access: The ability to request and obtain a copy of the personal data a business holds about you.

10. Notice of financial incentive for California residents

Through the SOTG App, we provide you with opportunities to receive payments in exchange for providing data and/or responding to surveys.  Through our surveys and the SOTG App, we may collect and share your personal information as described in this Privacy Policy.  This includes all categories of personal information listed in Section 8 of this Privacy Policy.

The terms associated with each survey, like the amount you will receive if you qualify for and complete the survey, are presented to you in the SOTG App.  Additional incentives may be available if you give permission for us to collect and share Geographic Location Information and Digital Data, including by participating in the Payday program described above.  Under California law, because we offer you payments related to the collection and sharing of personal information, our surveys are considered a “financial incentive.”  Payments can be redeemed in various ways, such as through Venmo, credits to your PayPal account, or virtual gift cards.

You opt into these financial incentives by participating in surveys and/or allowing us to collect Geographic Location Information and/or Digital Data.  California residents have the right to withdraw from the financial incentives we offer at any time.  You can pause or disable our collection of Digital Data and/or Geographic Location Information by using controls available in the SOTG App and/or your mobile device.  You may also stop providing Digital Data by disabling accessibility permissions on Android devices and disabling and/or uninstalling the VPN on iOS devices. Pausing or disabling our collection of Geographic Location Information and/or Digital Data will not pause or disable any other data collection through our Services, and you will continue to receive surveys through the SOTG App.  You can withdraw from survey participation by not responding to surveys or deleting the SOTG App from your mobile device.   

The amount of payment you receive for completing a survey and/or providing data is based on the reasonable determination of the value that we and our partners receive from processing personal information.  This estimated value takes into account a variety of factors as permitted by law, including (but not limited to) the expenses incurred in collecting and retaining the information, the expenses incurred in providing payments to you, and the estimated marginal revenue derived from information related to our surveys.

11. Changes to our privacy policy

We reserve the right to modify or revise this Privacy Policy at any time and in our sole discretion. We will post any changes to this Privacy Policy on our Services. We encourage you to revisit this policy regularly to stay informed about how we collect, use, and share your information.
