OFFICIAL RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. Void where prohibited by law and outside the United States. Subject to all federal, state, and local laws, regulations and ordinances. The weekly Surveys on the Go® giveaway promotion (“Giveaway(s)”) and the instant win game of chance (“Chance Game(s)”), together, shall be referred to as the “Prize Promotions".
BY PARTICIPATING IN THE PRIZE PROMOTIONS, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE PARTICIPATING. WITHOUT LIMITATION, THIS CONTRACT PROVIDES FOR INDEMNIFICATION OF THE SPONSOR AND OTHER PRIZE PROMOTION ENTITIES BY YOU, A CLASS ACTION AND JURY TRIAL WAIVER, A REQUIREMENT THAT MOST DISPUTES BE SETTLED BY MANDATORY BINDING ARBITRATION , AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.
- I am at least 16 years of age or older, and am otherwise eligible to participate in this prize promotion. If I am under the age of majority in my jurisdiction (18 in most states, except 19 in AL and NE, and 21 in MS), I acknowledge that I also have parental/guardian permission to participate and receive a prize.
These Official Rules are for separate promotions, each with their own separate start and end dates, entry pools, winner selections, and prizing options. Please review the rules in their entirety to learn which sections, deadlines, and details apply to each of the separate promotions.
1. SPONSOR: The Sponsor for the Prize Promotions is MFour Mobile Research, Inc. dba Surveys On The Go®, 19800 MacArthur Blvd., Suite 700, Irvine, CA 92612 (“Sponsor”). Apple Inc. is not a sponsor, nor is it involved in any way with the Prize Promotions offered through this application.
2. ELIGIBILITY: The Prize Promotions are open only to legal residents of the fifty United States and District of Columbia (“D.C.”) who: (a) are 13 years of age or older, and (b) are located in and legal residents of one of the 50 United States or D.C. at the time of entry. Void in Puerto Rico, and all other U.S. and foreign territories and possessions, and wherever else prohibited or restricted by law. By participating, entrants agree to these Official Rules and the decisions of Sponsor, which are final and binding in all matters relating to the Prize Promotions.
3. PROMOTION PERIODS: Each Giveaway and Chance Game constitutes its own, separate prize promotion, with separate start and end dates and prizing. Sponsor’s computer is the official timekeeping device for the Prize Promotions. The separate entry periods are as follows:
a. The Giveaways: Beginning on 9 October, 2024, the Giveaways will begin at 12:01a.m. Pacific Time (“PT”) on Monday of each calendar week and will end at 11:59 p.m. PT on the following Sunday of that same calendar week (each, a “Giveaway Entry Period”).
b. The Chance Games: Beginning on 9 October, 2024, the Chance Games will begin at 12:01 a.m. PT on any given calendar day and will end at 11:59 p.m. PT on the same calendar day (each, a “Chance Games Entry Period”).
Sponsor may choose to end any future portion of the Prize Promotion, or the Prize Promotion in its entirety, at any time and at least seven (7) days prior to the start of the next applicable start date, at which time these rules will no longer apply to any future prize promotions except for those sections which shall survive termination, including Section 11, Disputes.
4. HOW TO ENTER: To participate and enter into the Prize Promotion, all potential entrants must first register for a Surveys On The Go® account. If you do not already have a registered account, you may create one for free by first downloading the Surveys on The Go® app from the Apple App store or Google Play. Then, follow the on-screen prompts to create and register your account. Then, once you have logged into your Surveys On The Go® account, you may enter into the Giveaways and/or the Chance Games by completing the following steps. Please note, entry into one Giveaway and/or Chance Game does not automatically enter you into an additional Giveaway and/or Chance Game, except as specifically indicated below.
a) The Giveaways: To enter a Giveaway, once registered for a Surveys On The Go® account, log into your account, and open the app. Upon successfully logging into your account and opening your app, you will be entered with one (1) entry into the Giveaway corresponding with the date and Giveaway Entry Period during which you opened the app. For example, if you log in and open the app on Wednesday, October 23, 2024, you will be entered with one (1) entry into the Giveaway Entry Period running from Monday, October 21, 2024 through Sunday, October 27, 2024. Limit one (1) entry per person per day through this entry method.
i) The Giveaways Bonus Entry Methods: Entrants may receive additional bonus entries into a Giveaway by completing the following steps:
1) “Chance Game Bonus Method”: Participating in and winning a Chance Game, as described below, will receive one (1) bonus entry into the Giveaway Entry Period associated with the date and time that the entrant won the Chance Game. Limit one (1) additional Chance Game Bonus Method per person, per day;
2) “Payday Program Bonus Method”: Entrants who are registered members of the Surveys On The Go® Payday program (“Payday Members”) and who successfully log into their account and open the app during a Giveaway Entry Period will receive five (5) bonus entries into the Giveaway Entry Period during which entrant opened the app. Limit five (5) additional Payday Program Bonus Method entries per person, per week;
b) The Chance Games: To enter a Chance Game, once registered for a Surveys On The Go® account, log into your account, and open the app. Then, select a Surveys On The Go® survey from the list of available surveys, and begin the selected survey. If the app determines that you are not qualified to complete the selected survey, you will be automatically entered with one (1) entry in the Chance Game for the associated Chance Game Entry Period. Then, complete the on-screen instructions to “play” the Chance Game presented. Limit one (1) entry per person per Chance Game Entry Period. Participation in a Chance Game is optional, and you may opt out of participation at any time.
Please note: By entering in this Prize Promotion, you signify and agree that your entry and any other materials submitted in connection with the Prize Promotions may be posted on Sponsor’s website and/or other social media sites or applications associated with the Prize Promotion in a manner that is consistent with these Official Rules. Upon submission of entry in a Prize Promotion, you agree that Sponsor may contact. Normal Internet access, phone, and usage charges imposed by your online or phone service may apply. If you are entering via a mobile device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply.
Automated entries, entries which use or in any way incorporate artificial intelligence or any other simulation of human intelligence or process through the use of a machine or computer system (collectively, “Artificial Intelligence”), either in the creation or submission of the entry or as a part of any entry, and/or third-party entries are prohibited. Any entry that was created by using, or in any way incorporates, Artificial Intelligence, or that was created or made by a third party, will be void, and the entrant who submitted such an entry may be disqualified at Sponsor’s sole discretion. Multiple entrants are not permitted to share the same email address or Surveys On The Go® account. Any attempt by any entrant to obtain more than the permitted number of entries by using multiple and/or different identities, forms, registrations, Surveys On The Go® accounts, addresses or any other method will void all of that entrant’s entries, and that entrant may be disqualified at Sponsor’s discretion. Incomplete, illegible, corrupted or untimely entries are void and will be disqualified. All entries become the exclusive property of the Sponsor and will not be acknowledged or returned except as provided herein. Sponsor and its agencies are not responsible for lost, late, incomplete, damaged, stolen, misdirected or illegible entries; lost, interrupted or unavailable network, server or other connections; or miscommunications, computer or software malfunctions, telephone transmission problems, technical failures, garbled transmissions, damage to a user’s computer equipment (software or hardware) or other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address associated with the Surveys On The Go® account will be deemed to be the entrant or participant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider or other organization (which may include an employer) responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. Entries specifying an invalid, non-working or inactive email address will be disqualified and ineligible to win.
5. WINNER SELECTION & ODDS:
a. The Giveaways: On or about the Monday immediately following the end of a given Giveaway Entry Period, Sponsor will select the name(s) of potential winners of prizes in a random drawing from among all eligible entries received. The winners of a Giveaway will be notified on or about the Tuesday immediately following the end of a given Giveaway Entry Period via an inbox message in the Surveys On The Go® mobile app and an email to the email address associated with entrants’ Surveys On The Go® account. You may view this inbox by navigating to the “Inbox” tab in Surveys On The Go® mobile app. The odds of winning a Giveaway are based on the number of eligible entries received for each Giveaway Entry Period.
b. Chance Games: Upon entry into any available Chance Game, eligible entrants who have been selected as a prize winner will immediately see the prize on-screen. Non-winning entries will receive a confirmation message on-screen. The odds of winning a Chance Game is 1:4.
Winning entries are determined solely on the basis of the time (to the second) when their entry is received and processed.
Non-winning entries will not carry over to subsequent Giveaways and/or Chance Games. You are not a winner until your prize claim is validated and you receive official written notification from the Sponsor.
6. PRIZE AWARD: If you receive a notification or inbox message indicating that you are eligible to win a prize in a Prize Promotion, follow the instructions provided on-screen to claim your prize. The Sponsor will send a one question survey to potential winners’ Surveys On The Go® app (“Confirmation Survey”). Potential winners must complete the Confirmation Survey to become a winner and receive the prize. A potential winner’s prize will be forfeited if the Confirmation Survey is not completed. Potential winners must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements in these Official Rules. If Sponsor is unable to determine and verify a potential winner after repeated alternate drawings or if they fail to receive a sufficient number of entries to correspond to the number of prize(s) available to be awarded, Sponsor reserves the right to not award any or all of the prize(s).
Verification of Potential Winners: ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PRIZE PROMOTIONS. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. Winning a prize is contingent upon fulfilling all requirements set forth herein.
7. PRIZES AND TOTAL VALUE:
a. The Giveaways: The following prizes will be available for each Giveaway:
i. One (1) winner will receive one (1) $100.00 credit to winner’s Surveys On The Go® app account.
ii. Two (2) winners will each receive one (1) $50.00 credit to winner’s Surveys On The Go® app account.
iii. Four (4) winners will each receive one (1) $25.00 credit to winner’s Surveys On The Go® app account.
iv. Ten (10) winners will each receive one (1) $20.00 credit to winner’s Surveys On The Go® app account.
Total Approximate Retail Value (“ARV”) of all seventeen (17) prizes per Giveaway: $500.00.
b. The Chance Games: The number and type of available prizes for each Chance Game will vary depending on the individual Chance Game. Prizes may include the following; to learn the exact number of prizes and total value of prizes available for a given Chance Game, please email support@surveysonthego.net for details:
i. Approximately 4,500 winners will each receive bonus entries into the corresponding Giveaway associated with the time and date which entrant participated in and won the Chance Game;
ii. Three (3) winners will each receive one (1) $5.00 credit to winner’s Surveys On The Go® app account.
iii. Ten (10) winners will each receive one (1) $1.00 credit to winner’s Surveys On The Go® app account.
iv. Three hundred and fifty (350) winners will each receive one (1) $0.50 credit to winner’s Surveys On The Go® app account.
vi. Two thousand six hundred and fifty winners (2,650) will each receive one (1) $0.05 credit to winner’s Surveys On The Go® app account.
Total Approximate Retail Value (“ARV”) of all approximately 7,513 prizes per Chance Game: $332.50.
No prize substitution, cash substitution, or assignment or transfer of prizes is permitted. Limit one (1) prize per person for each Giveaway and limit one (1) prize per person for each Chance Game. Any and all applicable federal, state and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein are the responsibility solely of winner. Prize cannot be substituted, assigned, transferred or redeemed for cash; however, Sponsor reserves the right to make equivalent prize substitutions at their discretion. Prize credits are eligible to cash out when winners’ account balance reaches ten ($10.00) dollars. Sponsor will not replace any lost or stolen prizes. Prize cannot be used in conjunction with any other promotion or offer. Only the number of prizes stated in these Official Rules is available to be won in the Prize Promotion. If, by reason of a print or other error, more prizes are claimed than the number set forth in these Official Rules, prize winner(s) will be selected in accordance with the winner selection method described above from among all eligible claimants making purportedly valid claims to award the advertised number of prizes available. Sponsor is not responsible for any delay or cancellation of the prize delivery due to unforeseen circumstances or those outside of their control.
8. GENERAL CONDITIONS: Prize Promotion participation constitutes entrant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Prize Promotion. In the event there is a discrepancy or inconsistency between disclosures or other statements (in any and/or all media) contained in any Prize Promotion materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Proof of sending or submission of entry will not be deemed proof of receipt by Sponsor. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS PRIZE PROMOTION OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE PRIZE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to disqualify any individual it finds to be attempting to tamper with or to undermine the entry process, any website or mobile application associated with the Prize Promotion, and/or the legitimate operation of the Prize Promotion; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten or harass any other person. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Sponsor and its agents are not responsible for (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Prize Promotion; (2) technical failures of any kind, including, but not limited to, malfunctions, interruptions or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Prize Promotion; (4) technical or human error that may occur in the administration of the Prize Promotion or the processing of entries; or (5) any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Prize Promotion or receipt or use or misuse of any prize. Sponsor reserves the right to cancel, suspend and/or modify the Prize Promotion, or any part of it, if any fraud, technical failures or any factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Prize Promotion, as determined by Sponsor. If, for any reason, the Prize Promotion cannot be run as planned, Sponsor may disqualify any suspect entries and (a) suspend the Prize Promotion and modify the Prize Promotion to address the impairment, then resume the Prize Promotion in a manner that best conforms to the spirit of these Official Rules; and/or (b) terminate the Prize Promotion and award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment.
9. LIMITATION OF LIABILITY AND RELEASES: BY PARTICIPATING IN THIS PRIZE PROMOTION, ENTRANT AGREES TO RELEASE, INDEMNIFY, DEFEND AND HOLD HARMLESS PRIZE PROMOTION ENTITIES, AND THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS, LEGAL COUNSEL, ADVERTISING, PUBLIC RELATIONS, PROMOTIONAL, FULFILLMENT AND MARKETING, WEBSITE PROVIDERS, WEB MASTERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS (THE “RELEASED PARTIES”), AND THAT THE RELEASED PARTIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE OR USE OF THE PRIZE, ENTRY OR PARTICIPATION IN THIS PRIZE PROMOTION OR IN ANY PRIZE PROMOTION -RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. PUBLICITY AND INTELLECTUAL PROPERTY RELEASE: EXCEPT WHERE PROHIBITED BY LAW, PARTICIPATION IN THE PRIZE PROMOTION CONSTITUTES WINNER’S PERMISSION AND GRANT TO SPONSOR (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF SPONSOR) AND ITS DESIGNEES THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING, BUT NOT LIMITED TO, THE WORLD WIDE WEB, AT ANY TIME OR TIMES, THE WINNER’S ENTRY, NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, OPINIONS AND BIOGRAPHICAL INFORMATION (INCLUDING, BUT NOT LIMITED TO, HOMETOWN AND STATE), PRIZE INFORMATION, QUOTES ATTRIBUTABLE TO WINNER, AND ANY OTHER ELEMENTS OF ENTRANT’S PERSONA FOR ADVERTISING, TRADE AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION OR NOTIFICATION, INCLUDING IN A LIST TO BE USED BY SPONSOR AND ITS DESIGNEES AND ITS PARTNERS TO RE-TARGET ENTRANTS VIA EMAIL OR ANY SPONSOR APP, UNLESS PROHIBITED BY LAW.
WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS PRIZE PROMOTION, INCLUDING EACH WEBSITE ASSOCIATED WITH THIS PRIZE PROMOTION AND ALL PRIZES, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. 11. DISPUTES: This Prize Promotion is governed by the laws of the United States. Except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Prize Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate United States District Court in California or the appropriate State Court located in Orange County, California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Prize Promotion, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of California.
12. SEVERABILITY: If any term or provision of these Official Rules is found under the law to be invalid or unenforceable, then such specific term or provision shall be of no force and effect and shall be severed, and the remainder of these Official Rules shall continue in full force and effect.
13. PRIVACY: Information collected from Entrants is subject to the Sponsor’s Privacy Policy, which can be found at https://surveysonthego.com/terms/.
14. WINNERS’ LIST: To view the winners’ list for the Prize Promotion, please visit Surveys On The Go® (“SOTG”) Help Center: https://sotgsupport.zendesk.com/hc/en-us/articles/20566809218331--500-Weekend-Giveaway-Winners-List. The winners’ list will be available after winner selection and validation has been completed for a Giveaway Period.
