SURVEYS ON THE GO GIVEAWAYS
OFFICIAL RULES
1. ELIGIBILITY: This promotion is open only to legal residents of the fifty United States and District of Columbia, who have reached the age of majority at time of entry. Void in Puerto Rico, and all other U.S. and foreign territories and possessions, and wherever else prohibited or restricted by law. By participating, entrants agree to these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Surveys On The Go Giveaways (the “Giveaways”).
2. ENTRY PERIODS: The Giveaways will begin at 12:01a.m. Pacific Time (“PT”) on Saturday of each week and end at 11:59pm PT Sunday of that same week (the “Giveaway Period”). There will be a weekly Giveaway through Tuesday December 31, 2024 (the “Promotional Period”).
3. HOW TO ENTER. You may qualify for a weekly Giveaway if you maintained or enabled Digital Surveys and Location Services settings in the Surveys On The Go Mobile App (the “SOTG App”) during the Giveaway Period of a week within the Promotional Period. Each week will be a separate Giveaway. The Sponsor will send you a one question survey (“Entry Survey”) in the SOTG App at the start of the Giveaway Period of a week. You will be entered in that week’s Giveaway if you complete the Entry Survey by 11:59pm PT Sunday of that same week.
4. DRAWINGS: Potential winners will be selected from all eligible entries for a Giveaway Period. The drawing for each Giveaway Period will be held on the Monday following the end of the Giveaway Period. Non-winning entries for each Drawing Period will not be carried over to subsequent Giveaway Periods. The Sponsor’s decisions are final and binding in all matters related to the Giveaways. The Sponsor will notify potential winners and non-winners by sending a message to eligible participants’ inbox in the SOTG App.
5. PRIZES/ODDS: The prizes for each Giveaway Period will be as follows:
1st prize: $100 credit to your SOTG App account (one winner)
2nd prize: $50 credit to your SOTG App account (two winners)
3rd prize: $25 credit to your SOTG App account (four winners)
4th prize: $20 credit to your SOTG App account (ten winner)
The Sponsor will send a one question survey to potential winners’ SOTG App (“Confirmation Survey”). Potential winners must complete the Confirmation Survey to become a winner and receive the prize. A potential winner’s prize will be forfeited if the Confirmation Survey is not completed. No prize substitution, cash substitution, or assignment or transfer of prizes is permitted. Limit one (1) prize per person for each Giveaway Period. Taxes on prizes are solely the winner’s responsibility. Odds of winning in any Giveaway Period depend upon the total number of eligible entries received for a Giveaway Period.
6. LIABILITY LIMITS AND INDEMNITY: By participating, all entrants and winners, on behalf of themselves, their executors, heirs and assigns hereby: (a) release the Sponsor and its respective parent entities, subsidiaries and affiliated companies and all of its respective officers, directors, employees, representatives and agents (collectively, “Released Parties”), from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses of any kind to persons or property, including death and bodily injury, which may be sustained in connection with the conduct or outcome of the promotion or the receipt, ownership or use or misuse of any prize awarded, (b) indemnify and hold harmless Released Parties from and against any and all claims arising from the acts or omissions of entrant or winner. Under no circumstances will Released Parties be liable for punitive, incidental, consequential, or special damages (including lost profits) or any other damages in excess of actual out-of-pocket costs incurred (if any) not to exceed $50, but in no event will attorneys’ fees be awarded or recoverable.
7. LIMITATIONS OF LIABILITY: Released Parties are not responsible for incomplete, non-delivered, misdirected, or for incomplete, inaccurate, lost, interrupted or unavailable network, server, satellite, Internet Service Provider (ISP), Web site, telephone networks or lines, cellular towers or equipment (including handsets), computer online systems, computer equipment, software, viruses or bugs, servers or providers, or other connections, availability or accessibility; or for unauthorized access to, or alteration of entries; or miscommunications, failed computer, telephone, cellular, satellite, or cable transmissions, lines, or other technical failure; or for jumbled, scrambled, delayed, or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties; or for any other errors of any kind, whether human, technical, mechanical, electronic or network, including, without limitation, any errors which may occur in connection with the administration of the Sweepstakes or in any Sweepstakes-related materials; or for the incorrect or inaccurate capture of entry or other information, or the failure to capture, or loss of, any such information. Persons who tamper with or abuse any aspect of the Sweepstakes or SOTG App, as solely determined by the Sponsor, will be disqualified (and all associated entries will be void), and Sponsor reserves the right to terminate such entrant’s eligibility in this or any other promotion offered by Sponsor. Entries generated by a robotic, programmed, script, macro or other automated means or by any means which subvert the entry process will be disqualified. Released Parties are not responsible for injury or damage to participant’s or to any other person’s computer, tablet or mobile devise or similar devise related to or resulting from participating in this Sweepstakes or downloading materials from or use of the SOTG App. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to modify, suspend or terminate the Sweepstakes, and select winners for the corresponding drawing from all non-suspect, eligible entries received for such drawing prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Without limiting the release provided above, and for greater certainty, Released Parties will not be liable for (a) any incomplete or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes, or by any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, or technical or human error which may occur in the processing of entries; (b) the theft, destruction or unauthorized use of or access to, or alteration of, entries; (c) any problems with or technical malfunctions of telephone networks or lines, computer online systems, servers or providers, computer equipment, software, viruses or bugs; (d) any failure of any message to be received by or from Sponsor for any reason including but not limited to traffic congestion on the Internet or wireless waves or at any Web site, SOTG App or combination thereof; or (e) damage to a participant’s or other person’s system or equipment occasioned by participation in this Sweepstakes. In the event of a dispute regarding prize claims or online entries received from multiple users having the same SOTG App panelist ID, address, telephone number and/or e-mail account, the authorized subscriber of the SOTG App account at the time of entry will be deemed to be the entrant and must comply with these Official Rules. Authorized account subscriber is the natural person who is assigned the SOTG App panelist ID by the Sponsor.
IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE SOTG APP SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SOTG APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
8. GOVERNING LAW: Except where prohibited by law, all issues concerning the construction, validity, and enforcement of these Official Rules, or the rights and obligations of the entrant and Sponsor, shall be construed and governed by the laws of the State of California, without regard to conflicts of law. All suits or claims brought in connection with the Giveaways must be brought in a state or federal court in Orange County, California.
9. WINNERS LIST/OFFICIAL RULES REQUEST: The names of winners will be recorded on SOTG Help Center website for each Giveaway. You may also receive the names of the winners for a Giveaway Period or a copy of these Official Rules (designate which or both) by mailing a request to: Surveys on the Go Giveaways, c/o MFour Mobile Research, Inc., 19800 MacArthur Blvd., Suite 700, Irvine, CA 92612. Please include your return address. A winners list will be sent after all winners have been determined for a Giveaway Period.
